okay well the person i received this iphone froma person who is no longer living. i cant get passed the activation lock screen. What do i do?

Take the phone, the original purchase receipt, a copy of the will that shows you are the owner, a copy of the death certificate, and a photo ID to the nearest Apple Store.
so what if they are no longer alive? is there anyway to get passed the activation lock?
